To carry out the premeditated assault, the brothers allegedly received $3,500. Smollett was indicted by a grand jury in February 2019 on charges of filing a false police report, a class 4 felony. His next move was to surrender to the authorities in Chicago. Initially, all charges were dismissed in March. However, in April, he was charged on six counts after a Cook County grand jury heard a case brought against him by the city of Chicago.

In an Instagram live session, he discussed the subject with activist and writer Marc Lamont Hill while insisting on his innocence. For his deception to the police, Jussie received a 150-day prison term on March 10, 2022. On top of that, he has to pay $120,106 in reparations to the city of Chicago and serve 30 months of felony probation.
The following day, his attorneys submitted an appeal notice, and on March 16th, an appeals court in Illinois granted his request to post a personal recognizance bond of $150,000 and free him from jail. The 150-day sentence that Smollett received for the alleged hate crime fake was appealed by his counsel in March 2023.
